All customers and visitors to the online website https://www.ChromeCycleStudio.com (the "Website") are subject to the following Terms and Conditions (“Terms”). These Terms are designed to ensure that our customers are using our facility, services, and/or products in conformity with Chrome Cycle Studio's policies and procedures, standards, rules, regulations and requirements and with regard for the rights of all other users as well. By accessing, browsing and/or using this Website, you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions and to comply with all applicable laws and regulations. If you do not agree, please refrain from using this Website.

 

Please read these Terms carefully, as they contain important information regarding your legal rights, remedies, and obligations. In using this Website, you are deemed to have read and agreed to the following Terms and Conditions. 

WHAT TO EXPECT IN A CHROME CYCLE CLASS

Chrome Cycle Studio (“Chrome Cycle” or the “Studio”) conducts high intensity cardio classes that are interval-based and choreographed to music, in a group fitness setting on a stationary bike. Please be aware that the instructor for each class speaks over a mic and music, which may get loud. If you are sensitive to loud music, please consider using ear plugs.

Please note that all riders must be at least 14 years old and 4’11” tall at minimum to participate in classes at Chrome Cycle.

BOOKING POLICY

To book a class at Chrome Cycle, you must have an account and a valid class credit or membership to book a bike. To buy individual class credits or any membership, you can either sign up at this Website by using your email address and password to create an account; or if you are already registered, you may login to buy class credits or a membership and make your reservation.

Reservations are accepted on a “first come, first served” basis. Your purchase of a class credit or membership does not guarantee your entry into every class. Nor does it provide you access to private events, charity rides, specialty classes, or other irregular classes that may not be bookable on this Website.  

Your reservation in any class acts as a place holder and is subject to the Cancellation, No-Show, and Waitlist Policies explained immediately below.

CANCELLATION POLICY

To timely cancel a class that you reserved using a class credit or your membership, you may do so without penalty by canceling online, via the Mobile App, or by calling the studio NO LATER THAN four (4) hours before the reserved class start time. If your bike is canceled pursuant to this policy, your class credit will be returned to your account and/or any booking made under your membership will be cleared.

If you cancel your bike reservation WITHIN four (4) hours of the class start time, you are canceling in the “Late Cancel Window” and your single class credit or class credit under a limited membership will be forfeited; if you Late Cancel under an unlimited membership, you will be charged a $10 Late Cancel Fee. (If you do not have a working credit card on file for the Late Cancel Fee, your account may be temporarily frozen until your card on file is updated, at which time the $10 Late Cancel Fee will be assessed and your account reinstated.)

Class cancellations made via e-mail, Facebook Messenger, Instagram direct message, text message, or any other social media or contact platform will not be honored absent express written consent and response from the Studio, and you will remain subject to this Late Cancel Policy.

NO-SHOW POLICY

Should you fail to show up to a class you reserved using a class credit or limited membership, for whatever reason, your class credit will be forfeited.

Should you fail to show up for a class you reserved using an unlimited membership, you will be charged a $15 No Show Fee. If you do not have a valid credit card on file, your account will be frozen until your credit card is updated. Once we have an updated card on file, the No Show Fee will be assessed and your account will be reinstated.

Please be aware that in the event a class is full, we release all bikes three minutes before the start of class to those waiting in the Studio or on the class waitlist. If you are running late, please call the Studio and speak with a front desk staff member to ensure that we hold your bike for you.

WAITLIST POLICY

If a class is full and you choose to join the waitlist for that class, you are responsible for showing up to class if called off the Waitlist OR for canceling your waitlist reservation within the bounds of the cancellation policy. The Studio or its staff cannot be held responsible for ensuring your attendance by informing you that you have been accepted off the Waitlist. If you are booking the Waitlist, you are committing to showing up for the class time. Late Cancel and No-Show Policies apply if you do not cancel your reservation within the parameters of our Cancellation Policies.

The system will auto-populate clients into class from the waitlist as other clients with confirmed spots cancel, and bikes will be assigned as such. Chrome Cycle staff will add walk-ins and/or waitlisted clients in the order in which they were added to the Waitlist by the computer system, up to three minutes before the start of class. There is no waitlist priority given for early arrival.

RETURN AND EXCHANGE POLICY

You will always receive the value of your purchase at Chrome Cycle. We offer account credit for unused purchases of classes and memberships. If you have a circumstance under which you need a refund, please contact info@Chromecyclestudio.com with your inquiry or issue.

All retail product purchases may be returned within two weeks of the date of purchase, as long as such items are unworn, free from any marks or stains, and all original tags (if any) remain attached.

UNLIMITED CONTRACTS/MEMBERSHIPS

If you opt to purchase an Unlimited Monthly Contract (including the New Member Unlimited Month or Student Unlimited Month), you agree that the “month” is defined as 30 continuous days from the first class booked under the Unlimited Month. You may activate your Unlimited Month within thirty (30) days of purchasing the contract option. There are no refunds given for the purchase of an Unlimited Month. You may pause or freeze your Unlimited Month one time during the 30-day period for a minimum of seven (7) days.

RECURRING CONTRACTS (LIMITED & UNLIMITED MEMBERSHIPS)

If you choose to enroll in a recurring Limited or Unlimited recurring contract, you understand that your credit or debit card will be automatically charged on a recurring monthly basis for the duration of the contract term. By opting into the membership option, you authorize Chrome Cycle to automatically charge the credit or debit card specified in your account profile.

You may cancel any recurring membership as specified in the particular contract chosen by sending an email to info@Chromecyclestudio.com. All contract termination notices require a 30-day notice.

WAIVER AND RELEASE OF LIABILITY

When you visit Chrome Cycle or send emails to us, you are communicating with us electronically, and therefore consent to receive communications from us electronically in response. We will communicate with you by email or by posting notices on this Website. You agree that all agreements, notices, disclosures, and/or other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

By signing up for and/or attending Chrome Cycle classes, activities and/or other events, and using Chrome Cycle’s facility and equipment, you hereby agree that there are certain inherent risks and dangers inherent to indoor cycling classes and exercise and in participating in our indoor cycling classes and using our exercise equipment in association with the classes.

In consideration of participating in Chrome Cycle classes you agree to assume full responsibility for any and all injuries or damage which you may sustain in as a result of taking or in relation to Chrome Cycle classes. You further agree to waive, release and forever discharge Chrome Cycle, its officers, agents, members, employees, representatives, and assigns from any and all responsibility, claims, rights, causes of action and/or liability from injuries or damages to your person or property resulting from your participation in Chrome Cycle classes.

COOKIES

Cookies are small text files sent to your browser from a website and stored on your computer’s hard drive. Cookies cannot read data from your hard disk or read cookie files that were created by other sites. This Website uses cookies to obtain certain types of information, such as your user name and password, to customize content areas or to analyze site activity and user behavior. PRIVACY STATEMENT

We at Chrome Cycle are committed to protecting your privacy. Our Privacy Policy outlines the type of information we receive and collect when you use the features on our Website as well as some of the steps that we take to safeguard the information. Please read our Privacy Policy before using this Site or submitting your personal information to us. By using this Site, you accept the practices described in our Privacy Policy.

We do not sell any of your information to anyone.

INTELLECTUAL PROPERTY RIGHTS

“Chrome Cycle” and the “CC” chain-link logo and other graphics, photos, logos, designs, page headers, button icons, copyright information and/or trademarks of Chrome Cycle Studio, LLC, are the exclusive property of Chrome Cycle and may not be used by you for any other reason other than as expressly permitted by these Terms. Any use of the materials on this Website without the prior written permission of the Studio is strictly prohibited.

DISCLAIMER

In no event shall Chrome Cycle, its employees, agents, or assigns be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any errors, mistakes, or inaccuracies of content; personal injury, illness or property damage resulting from your access to and use of our Website; any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein; any interruption or cessation of transmission to or from our Website; any bugs, viruses, or the like, which may be transmitted to or through our Site by any third party; and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Chrome Cycle Website, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

You specifically acknowledge that Chrome Cycle shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

OTHER GENERAL PROVISIONS

LOCKERS & COMMON AREAS: Lockers are provided solely for the benefit and convenience of our members. Chrome Cycle is not responsible for anything left in our lockers. Our staff will remove (and may discard) any articles left in a locker overnight.

MOBILE PHONES & OTHER DEVICES: We want to ensure the best experience for each customer at our Studio. To ensure consideration to all riders in a group fitness setting, we require that all mobile phones must be turned off and stored during class unless prior permission has been granted.

Apple watches and any other fitness tracking devices should be dimmed and/or silenced during class.

 

ADVERTISING & SOCIAL MEDIA PHOTOS: Chrome Cycle may photograph and record you before, during, or after class while you are at the premises. We may publish and distribute these photographs and recordings in connection with your participation in Chrome Cycle activities and your attendance in class. By acknowledging these terms, you agree and consent that Chrome Cycle may display these photographs and recordings through our Website and any/all social media channels, as well as any advertising channels seen fit.

RESERVATION OF RIGHTS

Chrome Cycle reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

Chrome Cycle may revise these Terms at any time by updating this page. By continuing to use this Website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine all current Terms and Conditions to which you are bound.
